Our clients respectively own the artwork and code created as part of the projects. In most cases the client retain their materials on individual servers purchased by a third party. Atvn and Madcap Media is not liable or responsible for damaged or loss of data, recovery costs or loss of business due to uptime or corruption of any server data lies upon. Madcap actively stores backup work files for active clients, but is neither responsible nor liable for backup storage fees of clients or projects removed from a billing cycle after 31 days. Madcap in good faith will execute recovery procedures to check and recover any data from active or past clients at a minimum cost of $75/hr CAD, but cannot guarantee recovery, accuracy or validity of the information or data of any project 31 days after its completion. All unpaid balances must be reconciled prior to the recovery procedures. We highly recommend purchasing work files and storing them on secondary backup servers or hard drives.
All web and design projects include data and elements not purchased by the clients; scripts, licenses, fonts, graphics, icons, additional imagery used in projects, video players, etc. As such additional costs are required for Raw work files of the projects. Client has every opportunity at the conclusion of each project to request and purchase project work files for 10% cost of the project. For example, a $700 Business Card design work file would cost $70 to purchase on its completion (non licensed fonts would be provided as well as all layers and imagery for your editing).
All final and approved web work files remain on the servers of the client. All final artwork is sent for approval to client via email and remains with the client at all time. Madcap is not responsible for deletion of these materials from client end." |
